These Terms & Conditions ("Terms") govern the use of eeVote, a multi-tenant e-voting platform for apartment, villa and gated communities, operated by AL TechSpire LLP ("eeVote", "we", "us"). By creating an account or using the platform, you agree to these Terms; if you do not agree, do not use eeVote.

1. The service

eeVote lets a community set up its property structure and voter roll, run mock and real elections with dual-control approval, and publish tamper-evident, secret-ballot results, backed by a pay-as-you-go credit wallet for notification costs.

2. Accounts and eligibility

  • An account is created and verified using a mobile number and OTP; you're responsible for keeping access to that number secure, and for all activity under your account.
  • Information you or your community provide (property structure, voter roll, candidate details) must be accurate to your knowledge, and kept up to date.
  • One account should correspond to one real person; creating accounts to impersonate or misrepresent another resident is not permitted.
  • You must be legally competent to enter into a binding contract to use eeVote.

3. Community and admin responsibilities

A community's Account Admin and Committee Admins are responsible for the accuracy of their property structure, voter roll, and election configuration, and for obtaining any consents and approvals required under their own community's governing rules (society bye-laws, association constitution, or equivalent) before running a binding election. eeVote provides the platform and process controls; it is not a party to, and does not adjudicate, a community's own internal governance disputes.

4. Elections

  • Every election requires two independent, OTP-verified approvals before voting opens, and again before results are published — this cannot be bypassed by a single administrator.
  • Once locked, an election's roster, positions and candidates cannot be changed.
  • Mock elections use a clearly-marked, limited batch of test voters kept separate from the real voter roll, and their results carry no legal or binding effect.
  • Published results include a verification code and hash for independent verification, without revealing any individual ballot.

5. Credits and billing

  • Your subscription plan sets structural limits (communities, voters, admin users); a separate credit wallet is debited only when a notification actually sends or a mock voter is generated.
  • Fees are quoted and charged in Indian Rupees (INR) inclusive of applicable taxes, unless stated otherwise.
  • Purchased credits are generally non-refundable once consumed. Unused credits may be subject to the refund/adjustment terms shown in your billing dashboard.
  • Plan pricing and credit rates may change; you will be notified of material changes before they take effect on your account.

6. Acceptable use

You agree not to: register fraudulent or duplicate voters, attempt to manipulate or bypass the dual-control approval process, interfere with the secrecy of the ballot, probe or attempt to circumvent the platform's security controls, or use the platform for any election or purpose unlawful under rules applicable to your community or under Indian law.

7. Intellectual property

The eeVote platform, its branding and underlying software remain the property of AL TechSpire LLP and its licensors. Your community's own data (voter rolls, election configuration, results) remains yours; we process it only to provide the service, as described in our Privacy Policy.

8. Disclaimer of warranties

The service is provided "as is" and "as available." While eeVote is built around dual-control approval, tamper-evident locking and audit logging, we do not warrant that the service will be uninterrupted, timely, secure, or error-free, and we disclaim all other warranties, express or implied, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, eeVote and AL TechSpire LLP are not liable for indirect, incidental, special or consequential damages, or loss of data, revenue or goodwill, arising from use of the platform, including disputes over an election's outcome that fall under your community's own governing rules rather than a platform defect. Our aggregate liability for any claim arising from these Terms is limited to the amount you paid us for the service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate an account that violates these Terms, with notice where practicable. You may close your account at any time, subject to any elections still in progress being properly concluded. Sections that by their nature should survive termination (including Sections 7, 8, 9 and 14) continue to apply after your account is closed.

11. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including internet or telecom outages, third-party SMS/WhatsApp gateway or payment processor failures, natural disasters, or government action.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where required by law we will provide additional notice; continued use of eeVote after a change takes effect constitutes acceptance of the updated Terms.

13. Assignment and severability

You may not assign your account or these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

14. Governing law and dispute resolution

These Terms are governed by the laws of India, and disputes arising from them are subject to the exclusive jurisdiction of the competent courts of India, without regard to conflict-of-law principles.
